These Terms of Service (“Terms”) govern your access to and use of [WEBSITE URL] and your purchases from D&S Select.

By visiting our website, creating an account, placing an order or using our services, you agree to these Terms and our Privacy Policy, Shipping Policy, and Return, Refund and Cancellation Policy.

If you do not agree with these Terms, please do not use the website or place an order.

You must be legally capable of entering into a binding contract under Indian law to place an order.

If you use the website on behalf of another person or organization, you confirm that you have authority to act for and bind that person or organization.

2. Account terms

You may be able to browse or purchase as a guest. Certain website features may require a customer account.

When creating or using an account, you agree to:

  • Keep your account information updated;

3. Product descriptions

We aim to present product descriptions, photographs, specifications, dimensions, materials and other information accurately.

However:

  • Colours may vary slightly because of lighting, photography or screen settings;
  • Measurements may have reasonable manufacturing tolerances;
  • Packaging may change without materially changing the product;
  • Images may contain props or accessories that are not included;
  • Product appearance may differ slightly between production batches; and
  • Availability may change without notice.

The product page and order confirmation should be reviewed carefully before purchase.

If a product is materially different from its advertised description, damaged, defective, incomplete or incorrect, it will be handled under our Return, Refund and Cancellation Policy and applicable law.

4. Pricing

Unless stated otherwise, prices are displayed in Indian Rupees.

Applicable taxes, delivery fees, Cash on Delivery charges, convenience fees or other permitted charges will be disclosed before you confirm the order.

We may change prices prospectively at any time. A price change will not ordinarily affect an order that has already been accepted.

If a product is listed at an obviously incorrect price because of a technical or human error, we may contact you before fulfilment to:

  • Confirm the corrected price;
  • Allow you to cancel the affected item; or
  • Cancel the order and issue a refund.

5. Discounts and promotions

Discount codes, promotional offers and sales:

  • Are subject to their stated conditions;
  • May have expiry dates or eligibility requirements;
  • May apply only to selected products or customers;
  • May not be combined unless expressly permitted;
  • Cannot be exchanged for cash; and
  • May be withdrawn before an order is submitted.

If a discount is applied because of an error, misuse or violation of its stated conditions, we may correct or cancel the affected order before fulfilment.

6. Payment

Available payment options may include cards, UPI, net banking, digital wallets, Cash on Delivery or other methods displayed during checkout.

Payments may be processed by third-party payment providers. We do not ordinarily receive or store complete payment-card credentials.

You agree to provide accurate billing and payment information and confirm that you are authorized to use the selected payment method.

A payment authorization or automated order-confirmation message does not necessarily mean that the order has been accepted. We may verify payment, inventory, delivery eligibility and order information before fulfilment.

If payment fails or cannot be verified, the order may be placed on hold or cancelled.

7. Order acceptance

Submitting an order constitutes an offer to purchase.

An order may be considered accepted when we:

  • Send an order-acceptance or dispatch confirmation;
  • Mark the order as fulfilled; or
  • Otherwise begin fulfilment.

We may decline or cancel an order before acceptance for legitimate reasons, including:

  • Product unavailability;
  • Incorrect pricing or product information;
  • Failed or unverifiable payment;
  • Suspected fraud or misuse;
  • Delivery restrictions;
  • Duplicate or unusually large orders;
  • Legal or regulatory restrictions; or
  • A technical or administrative error affecting the order.

If we cancel a paid order, we will initiate the applicable refund within 5 business days.

We will not arbitrarily refuse orders or discriminate between customers contrary to applicable law.

8. Order changes and cancellations

You may request cancellation of an eligible order before the item is fulfilled.

To request cancellation, use the chat option available on our website with your order number.

Once an item has been fulfilled or dispatched, cancellation may no longer be possible. After delivery, you may request a return in accordance with our Return, Refund and Cancellation Policy.

Products clearly marked as final sale may have different cancellation restrictions disclosed before purchase, subject to applicable law.

9. Cash on Delivery

Cash on Delivery may be available for selected products, order values and delivery locations.

We may verify a COD order through phone, WhatsApp, OTP or another reasonable method before fulfilment. An unverified order may be placed on hold or cancelled.

Any applicable COD charge will be disclosed before the order is confirmed.

Customers must not place orders they do not genuinely intend to accept. Repeated fraudulent, abusive or unjustified refusals may result in COD restrictions or account review, subject to applicable law.

10. Shipping and delivery

We deliver to supported locations displayed during checkout.

Estimated delivery periods are provided in business days and are not guaranteed unless expressly stated.

Delivery may be affected by:

  • Courier operations;
  • Weather or natural events;
  • Public holidays;
  • Strikes or transportation disruption;
  • Incorrect or incomplete addresses;
  • Customer unavailability;
  • Remote-area restrictions;
  • Regulatory checks; or
  • Other circumstances outside our reasonable control.

You are responsible for providing a complete and accurate delivery address and a reachable telephone number.

If an order must be reshipped because of incorrect customer-provided information or repeated unsuccessful delivery attempts, additional charges may apply where permitted and disclosed.

If an order is materially delayed beyond its stated delivery schedule, contact us through the chat option available on our website.

11. Delivery inspection

Please inspect the package promptly after delivery.

If the product is damaged, defective, incorrect or incomplete:

  • Retain the product;
  • Retain the original packaging and shipping label;
  • Take clear photographs or videos; and
  • Contact us within the period stated in our Return, Refund and Cancellation Policy.

An unboxing video may assist our investigation, but it will not be treated as the sole acceptable evidence in every case.

12. Returns, refunds and exchanges

Returns, replacements, exchanges, refunds and returnless resolutions are governed by our separately published Return, Refund and Cancellation Policy, which forms part of these Terms.

Where that policy conflicts with a mandatory consumer right, applicable law will prevail.

Nothing in these Terms excludes remedies for products that are defective, deficient, spurious, incorrect, unsafe, materially different from their description or delivered materially later than an agreed schedule, subject to applicable law.

13. Refund timing

Once a refund is approved, it will be initiated within the period stated in our Return, Refund and Cancellation Policy.

Prepaid-order refunds will normally be sent to the original payment method. Cash on Delivery refunds may be issued through UPI or bank transfer.

Banks and payment providers may require additional time to credit the amount after initiation. External processing times are outside our direct control.

14. Product use and safety

You are responsible for reading and following all product instructions, warnings and usage limitations.

Products must be used only for their intended purposes. We are not responsible for loss caused solely by:

  • Misuse;
  • Unauthorized alteration;
  • Improper installation;
  • Failure to follow supplied instructions; or
  • Continued use after a defect or safety concern becomes apparent.

This section does not limit liability that cannot be excluded under applicable law.

15. Intellectual property

The website and its original content, including our name, logo, text, layout, graphics and photographs, are owned by us or used with authorization and may be protected by intellectual-property law.

You may use the website for personal, non-commercial shopping purposes.

You may not, without permission:

  • Copy or reproduce protected content;
  • Modify or distribute website materials;
  • Use our branding to imply endorsement;
  • Scrape or systematically extract website data;
  • Sell, license or commercially exploit protected materials; or
  • Infringe our or another party’s intellectual-property rights.

Third-party trademarks and product names remain the property of their respective owners.

If you submit a review, photograph, video, comment or other content, you confirm that:

  • You have the right to submit it;
  • It reflects your genuine experience;
  • It is not false or misleading;
  • It is not unlawful, abusive or defamatory;
  • It does not infringe another person’s rights; and
  • It does not contain another person’s personal information without authorization.

You grant us a non-exclusive, worldwide and royalty-free licence to display and use submitted content for operating and promoting the store, subject to our Privacy Policy and applicable law.

We may moderate or remove content that is fraudulent, irrelevant, unlawful, abusive or infringing. We will not knowingly create or publish fake consumer reviews.

17. Prohibited uses

You must not use the website or services to:

  • Violate applicable law;
  • Commit fraud or impersonate another person;
  • Submit false order, payment, return or refund information;
  • Attempt unauthorized access to an account, system or network;
  • Introduce malware, viruses or harmful code;

  • Send spam, abusive messages or unlawful content;

Independent third-party services may have their own terms and privacy policies. We are not responsible for services or websites that we do not own or control.

This section does not remove our responsibility for providers acting on our behalf where applicable law makes us responsible.

19. Website availability

We aim to keep the website accurate, secure and available, but we do not guarantee uninterrupted or error-free operation.

We may update, suspend or discontinue features for maintenance, security, legal or operational reasons. Where reasonably possible, such changes will not interfere with accepted orders.

20. Disclaimer

Products and services are provided subject to the descriptions, warranties and protections stated on the website and required by law.

To the maximum extent permitted by law, we disclaim implied warranties that may lawfully be excluded.

Nothing in these Terms excludes statutory guarantees, consumer remedies or other rights that cannot lawfully be excluded.

21. Limitation of liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special or consequential losses that were not reasonably foreseeable and did not result from our breach of a legal duty.

Where liability may lawfully be limited, our aggregate liability relating to a particular order will not exceed the amount paid for that order.

Nothing in these Terms excludes or limits liability for:

  • Fraud or fraudulent misrepresentation;
  • Wilful misconduct or gross negligence;
  • Death or personal injury caused by negligence;
  • Breach of mandatory consumer rights;
  • Defective or unsafe products where liability cannot be excluded; or
  • Any liability that cannot lawfully be restricted.

22. Indemnity

To the extent permitted by law, you agree to compensate us for direct losses arising from your deliberate unlawful use of the website, fraud, infringement of third-party rights or material violation of these Terms.

This provision does not apply to ordinary consumer complaints or limit statutory consumer rights.

23. Changes to these Terms

We may update these Terms to reflect changes in our business, services or legal obligations.

Updated Terms will apply prospectively from the date they are published. The Terms applicable when an order was placed will generally continue to govern that order unless a change in law requires otherwise.

24. Severability and waiver

If any provision is found invalid or unenforceable, the remaining provisions will continue to apply.

A delay or failure to enforce a provision does not waive our right to enforce it later.

25. Governing law and jurisdiction

These Terms are governed by the laws of India.

Subject to mandatory consumer-jurisdiction rights, disputes will be subject to the competent courts and consumer forums having jurisdiction in India.

Nothing in this section prevents a consumer from approaching a competent consumer commission, court or regulatory authority available under applicable law.
